1) Acceptance of Terms
By accessing, browsing, registering an account, or placing an order through the Platform, you confirm that you have read, understood, and agree to be bound by these Terms & Conditions, our Privacy Notice, and our Refund & Cancellation Policy (together, the “Terms”). If you do not agree, please do not use the Platform.
We may update these Terms from time to time. The “Effective date” will be updated accordingly. Your continued use of the Platform after changes are posted constitutes acceptance of the revised Terms.
2) Business & Regulatory Disclosures
We operate in the Emirate of Dubai, UAE. In compliance with UAE consumer protection requirements applicable to e-commerce providers, we make available our key business identification details and contracting information on the Platform (including in Arabic where required).

3) Eligibility & User Responsibilities
You must be at least 18 years old (or the age of majority in the UAE) to place orders using the Platform. You agree to:
* Provide accurate and complete information (including delivery address, building name, apartment/villa number, and a reachable UAE phone number).
* Use the Platform lawfully and not misuse it (including attempting to disrupt the Platform, place fraudulent orders, or abuse promotions).
* Keep your account credentials confidential and notify us immediately of any suspected unauthorized access.
4) User Accounts & Privacy (Data Protection)
If you create an account, you are responsible for all activities under your account.
We process personal data in accordance with applicable UAE data protection laws, including the UAE Personal Data Protection Law (Federal Decree-Law No. 45 of 2021), and implement reasonable security measures to protect your information.

5) Orders, Menu Availability & Pricing
5.1 Order acceptance
Submitting an order is an offer to purchase. We may accept, reject, or cancel an order at our discretion (for example, due to item unavailability, suspected fraud, address issues, or operational constraints). An order is typically considered accepted once you receive an order confirmation on the Platform.
5.2 Menu and availability
Menu items, ingredients, portion sizes, and packaging may vary and may change without notice. Photos are illustrative.
5.3 Pricing, VAT & minimum order
* All prices are listed in AED.
* VAT (5%) will be applied where required by UAE law and shown at checkout.
* Delivery fees, service fees (if any), and discounts/promotions will be shown before checkout.
* Minimum order value (if applicable) will be displayed on the Platform and may differ by area/time.
5.4 Obvious errors
If a price or description is displayed incorrectly due to a technical or typographical error, we may cancel the order and refund any amount paid for that order.
6) Delivery Policy (Dubai / UAE)
6.1 Estimated delivery times
Delivery times shown on the Platform are estimates only and not guaranteed. Delays can occur due to traffic, weather, security checks, building access procedures, peak demand, or other factors beyond our reasonable control.
6.2 Customer responsibilities
You are responsible for:
* Providing a complete and accurate delivery address and clear directions (including tower name, community, unit number, access code, and preferred drop-off instructions).
* Ensuring your phone number is reachable during delivery.
* Being available to receive the order at the specified location.
6.3 Delivery completion
Delivery is deemed completed when the order is delivered to the address provided, handed to you/your representative, left with reception/security per your instructions, or placed at your door where permitted and safe.
6.4 Failed delivery
If delivery fails due to incorrect address details, unreachable phone number, refusal to accept delivery, or no recipient available, the order may be treated as completed and may not be eligible for refund due to the perishable nature of food (see Refund & Cancellation Policy).
7) Food Safety & Allergy Disclaimer (Important)
While we follow food safety procedures and take reasonable precautions, our kitchen handles common allergens and ingredients that may cause allergic reactions, including but not limited to: nuts, peanuts, sesame, gluten, dairy, eggs, soy, fish, shellfish, and sulphites.
* Cross-contamination risk: We cannot guarantee that any item is completely free from allergens due to shared preparation areas and equipment.
* Customer duty to inform: You must clearly communicate any allergies or dietary restrictions before placing the order (via order notes and/or contacting us directly).
* Assumption of risk: By ordering, you acknowledge and accept this risk.
8) Payments
We accept online payments via credit/debit cards and other payment methods displayed at checkout. Payment processing may be handled by third-party payment service providers; you authorize us (and/or our providers) to charge the total payable amount to your selected payment method.
9) Promotions, Vouchers & Loyalty
Promotions are subject to availability and additional terms displayed on the Platform. We may modify or withdraw promotions at any time, to the extent permitted by law. Misuse (including multiple accounts, fraudulent activity, or reselling) may result in cancellation and/or account suspension.
10) Intellectual Property
All content on the Platform (including trademarks, logos, text, photos, designs, and software) is owned by or licensed to Nani and is protected by applicable laws. You may not copy, reproduce, distribute, or exploit content without our prior written consent.
11) Limitation of Liability (To the Extent Permitted by Law)
Nothing in these Terms excludes or limits rights that cannot be excluded under UAE law, including applicable consumer protection rights.
Subject to the foregoing, and to the maximum extent permitted by applicable law:
* We are not liable for indirect or consequential losses (such as loss of profit or opportunity).
* Our total liability for any claim relating to an order will not exceed the amount you paid for that order, except where mandatory law requires otherwise.
12) Force Majeure
We are not responsible for delays or failures caused by events beyond our reasonable control, including severe weather, road closures, government actions, utility outages, strikes, platform outages, or third-party service disruption.

14) Governing Law & Dispute Resolution
These Terms, and any dispute or claim arising from or relating to the Platform, Services, or orders, shall be governed by and construed in accordance with:
* the laws of the Emirate of Dubai, and
* the federal laws of the UAE.
15) Miscellaneous
* Severability: If any provision is held invalid, the remaining provisions remain in effect.
* No waiver: Failure to enforce a right is not a waiver.
* Language: If we provide translations, the English version will apply unless mandatory law requires otherwise. We will provide required consumer-facing disclosures in Arabic where applicable.
